Prop 8 supporters appeal ruling over judge’s sexuality

Just as announced, proponents of California’s Proposition 8 have filed the papers appealing Judge James Ware’s decision to reject the attempt to invalidate Jude Vaughn Walker’s ruling striking down the measure, based on his sexuality.

Proposition 8 proponents filed a motion in April after Walker said he was gay. Proponents of the measure said they believe he should have recused himself from the case and his sexuality compromised his judgment in his ruling. However, that appeal was struck down on June 14.

In a statement to Reuters, Matthew McGill, one of the attorneys for the couples challenging the ban, said ProtectMarriage.com, the group defending the ruling, had issued a “smear campaign” against Walker.

“The only thing surprising about this development is doing so in the face of such a well-reasoned opinion,” McGill told Reuters.
