A federal appeals court is expected to rule Tuesday, Feb. 7, on the constitutionality of California’s Proposition 8, a 2008 ballot initiative banning gay marriage.
No matter the decision of the U.S. 9th Circuit Court of Appeals, the case is likely to be appealed to the U.S. Supreme Court, which could decide next year whether gays and lesbians around the nation have the right to marry.
Former Chief U.S. District Judge Vaughn Walker, 67, a Republican appointee, struck down Prop. 8 in August 2010 and said it violated the federal constitution. ProtectMarriage, the sponsor of Proposition 8, appealed the ruling to the 9th Circuit.
